If you are willing to complete a rental application and back ground check, pay First/Last months rent and a security deposit there are many landlords out there willing to work with you. Honesty is the best policy, just be upfront and forthright in your application and explanation of this past felony. Don't let it haunt you. Are you gainfully employed? If so, Have your employer write a reference on your behalf.
You need to work with a property management company who can help you secure good rental housing.

You may be able to get your bank to work with you. They can suspend payments and even reduce your payment temporarily depending upon your hardship while you seek another tenant. Many times the bank would rather work with you than add another property to their inventory.

So many questions. As always I will say that I am not an attorney, so this is clearly a situation that I would refer you to. I'm just a real estate agent.
It sounds like your landlord is at least being a decent human being by not charging you rent until the situation is resolved. I would not pay the landlord another dime until you see how this whole thing plays out. Even if the landlord says it's all handled go ahead and give me the rent. I wouldn't until you have some type of confirmation from the bank.
The legal/illegal question about what you ask. My wife and I have a mortgage on a home that is our primary residence and that is how we qualified for our loan. If we move and decide to rent the place, it's not an issue. If we have never lived here, nor planned to and got a mortgage based on those terms. FRAUD! It's a jailable and pay a lot of money offense. What was the situation of your mortgage property before you got there?
Trying to get a modification on it as it's there permanent residence now that is creative on their part. That might be why they are not charging you rent.
My advice, open a savings account in the bank and put your rent money there. It might accumulate for several months while this thing drags out. There are several people that could contact you related to this I won't go into who all they could be or why but you've got a modification being attempted, foreclosure going on, and it smells like fraud (not on your part at all). Tell the truth to everybody. Don't get involved in any coverup or lies on the landlords part.
As far as not reporting this as income. That is between them and the IRS, the mortgage has nothing to do with it. Sorry for rambling. Feel free to vote for best answer :)... more
Hi -- Trailmark is a very nice, newer subdivision in Jefferson County Littleton, but the values tend to be pretty high. The homes are newer, but many are "upside down" on value, as they were purchase directly from the builder at the height of the real estate market.
